2. Orders, Product Information & Delivery

Order Acceptance: Your order is an offer to purchase. A contract is formed only when we confirm the order in writing and accept your payment. We reserve the right to decline or cancel any order — for example where stock is unavailable, a price has been listed in error, or we cannot verify the delivery details — and will refund you in full in such cases.

Service Availability: We supply tiles, marble, and sanitaryware to specified regions in India and to export markets. Orders outside our standard delivery area may attract additional freight charges or may be declined.

Product Information: Product images are illustrative. Natural stone such as marble and granite has inherent variation in grain, colour, veining, and texture, and ceramic and vitrified tiles may vary slightly between production batches. Such natural and batch variation is a characteristic of the material and is
not a defect. We recommend confirming shade and calibre from a physical sample before ordering.

Quantity: We advise ordering a wastage margin of 5–10% for cutting and breakage. Shade and batch matching cannot be guaranteed on repeat orders placed later.

Delivery: Delivery timelines and freight terms are set out in full in our
Shipping Policy. Stated timelines are estimates and are not of the essence of the contract.
• Prices: All prices are quoted in Indian Rupees (INR) unless stated otherwise and are subject to market fluctuation. The price confirmed on your order acknowledgement is final for that order.
• Pricing Errors: If a product is listed at an incorrect price due to a typographical or system error, we may cancel the order and refund any amount paid in full.
• Payment Methods: We accept Online Transfer, UPI, Net Banking, and major credit and debit cards. Card and UPI details are captured directly by our PCI-DSS compliant payment partners; we do not store your full card number, CVV, or UPI PIN.
• Taxes & Duties: Listed prices are inclusive of applicable GST unless stated otherwise at checkout. For export orders, customs duties, import taxes, and clearance charges in the destination country are the buyer's responsibility.
• Title & Risk: Ownership of the goods passes to you only upon receipt of full payment. Risk of loss or damage passes on delivery to you or your nominated site.
4. Cancellations, Returns & Refunds

Pre-Dispatch Cancellation: You may cancel for a full refund at any time before your order is dispatched from our warehouse.

Returns: Unused product in its original, unopened packaging may be returned within
30 days of delivery, subject to the conditions in our Refund Policy.

Custom Orders: Custom-cut marble slabs, bespoke sizes, and specially procured or imported items cannot be cancelled or returned once production or procurement has begun, except where the goods are defective.

Transit Damage: Tiles and sanitaryware are fragile. Damage or shortage must be reported within
48 hours of delivery with photographic evidence.

Full terms: Cancellations, returns, replacements, and refund timelines are governed by our
Refund & Cancellation Policy. Nothing in these terms limits your statutory rights under the Consumer Protection Act, 2019.
6. Electronic Communications & Consent
• Consent to contact: By submitting an enquiry form, lead form, or order, you consent to being contacted by us by phone, SMS, email, and WhatsApp in connection with that enquiry or order.
• Transactional messages: We will send you order confirmations, dispatch notices, delivery updates, and invoices. These are necessary to perform our contract with you and are sent for as long as the order is active.
• Promotional messages: We will send marketing about new collections and offers only where you have separately opted in.
• Opt-out: You may withdraw consent to promotional messages at any time by replying STOP on WhatsApp, using the unsubscribe link in our emails, or emailing admin@vestatiles.in. Withdrawal does not affect essential messages about an order already placed.
• Records: Communications sent to the contact details you provide are deemed received. Please keep your details current — we are not responsible for failed delivery caused by incorrect information you supplied.
7. User Conduct & Account Responsibilities
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.
• Accurate Information: You must provide accurate project and delivery addresses, contact numbers, and GST details. Re-delivery caused by incorrect information you supplied may be chargeable.
• Prohibited Actions: You must not place fraudulent orders, misrepresent your requirements, use our site to transmit malware, attempt to gain unauthorised access to our systems, scrape or harvest data, resell our content, or use automated means to interfere with the site.
• Suspension: We may suspend or terminate access to our services where we reasonably believe these terms have been breached.
All content on this website and on our official social channels — including the Vesta Tiles name and logo, product designs, photographs, catalogues, text, graphics, and layout — is owned by Marble Emporio or its licensors and is protected by Indian and international intellectual property law.
You may view and print content for your own personal or internal project use. You may not reproduce, republish, distribute, modify, or use our content or trade marks for commercial purposes without our prior written permission.
If you submit photographs, reviews, or other content to us or tag us on social media, you grant us a non-exclusive, royalty-free licence to display that content in our marketing, and you confirm you own the rights to it.
9. Product Warranty & Disclaimer
• Manufacturer warranty: Products are covered by the applicable manufacturer's warranty against manufacturing defects, where one is offered. Warranty claims require the original invoice.
• Not covered: Natural variation in stone; damage from improper installation, use of unsuitable adhesive or grout, chemical or acid cleaning, impact, structural movement, or normal wear; and any product installed after a visible defect was apparent.
• Inspect before installation: Tiles and slabs must be inspected for shade, calibre, size, and visible defects before installation. Once a product has been installed, it is deemed accepted, and we cannot accept a claim for a visible defect or shade variation.
• Disclaimer: Except as expressly stated in these terms and as required by law, our products and this website are provided on an "as is" basis without further warranties of any kind.
10. Limitation of Liability & Indemnity
To the maximum extent permitted by law:
• We are not liable for delays to construction schedules, loss of profit, loss of contract, or any indirect or consequential loss arising from a delay in supply or a defect in the goods.
• We are not liable for improper installation or workmanship by third-party contractors, or for damage caused by handling, storage, or site conditions after successful delivery.
• Our total aggregate liability in connection with any order shall not exceed the value of the goods actually paid for under that order.
• Force majeure: We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, strikes, transport disruption, government restrictions, or raw-material shortages.
• Indemnity: You agree to indemnify us against claims arising from your breach of these terms or your misuse of our website or services.
Nothing in this section excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.
11. Governing Law & Jurisdiction
These Terms & Conditions and any dispute arising out of or in connection with them are governed by and construed in accordance with the laws of India.
Subject to the dispute-resolution step below, the courts at Salem, Tamil Nadu shall have exclusive jurisdiction over any dispute arising from these terms or from your use of our services.
Dispute resolution: Before commencing proceedings, both parties agree to attempt in good faith to resolve the dispute by raising it with our Grievance Officer (Section 12) and allowing 30 days for a response.
Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any right does not amount to a waiver of it.
